Administrative Proceedings
Not all offenses are criminal. Violations of the New York State Health and Environmental codes are prosecuted separately in administrative courts such as the Environmental Control Board. Mr. Bachrach has extensive experience representing individuals and corporations accused of administrative violations. Mr. Bachrach has successfully defended administrative law cases ranging from a minor fifty-dollar ($50.00) fine, to fines in excess of one-million-dollars ($1,000,000.00), and his clients have included world-renowned record labels and recording artists.
Litigation Support
In additional to representing his own clients, Mr. Bachrach also assists other firms with their litigation needs. Mr. Bachrach is often consulted by other lawyers requesting his opinion on discrete legal issues, and drafts motions, briefs and sentencing memoranda for attorneys requesting his assistance. To that end, Mr. Bachrach also provides coverage for court appearances, including arraignments and other contested proceedings, and due to his extreme attention to detail, Mr. Bachrach has been called upon to act as a case manager for complex multi-defendant trials.
Civil Practice and Litigation
Mr. Bachrach's civil practice provides legal representation to plaintiffs and defendants in federal and state fraud, wrongful death and civil rights litigations. Mr. Bachrach also assists in the creation of living wills and health/medical proxies, so that individuals can be confident that their interests and desires will be advanced even under the worst of circumstances. Prior cases include the defense of an escrow agent involved in a two-hundred-million-dollar ($200,000,000.00) bankruptcy litigation.
International Criminal Law
International Criminal Law remains an embryonic field, existing primarily in The Hague. Nonetheless, with the creation of the ad hoc International Criminal Tribunals and the permanent International Criminal Court, domestic criminal defense has begun to evolve. More and more domestic courts have seen an increase in the reliance on treaties, both to support prosecutions and the defense. This is particularly evident when non-citizens are accused of crimes committed on United States soil, or when United States citizens are accused of crimes abroad, or accused of crimes here while they happen to be traveling abroad. Conflict of laws, extradition and deportation are consistent reminders of the expanding nature of criminal defense. Mr. Bachrach is both well aware and well versed in the commingling of treaties and domestic criminal defense, and Mr. Bachrach's clients can be assured that their attorney is prepared for any challenges this new field may bring.
