Since the Supreme Court's decisions in Blakely v. Washington and United States v. Booker, and the Second Circuit's en banc decision in United States v. Cavera, the federal sentencing guidelines are no longer treated as mandatory. Because they are now advisory, the judge must take them into consideration, but they do not dictate the sentence.
